Terms of Service
Version 2026-10-20.1 · In effect from 20 October 2026
These terms are an agreement between Samuel Charles Stephen O'Donnell (ABN 47 761 441 190) (“we”, “us”) and the business that registers for SiteTrack (“you”). By creating an account, or by using SiteTrack in any way, you accept them on behalf of yourself and your company. If you do not accept them, do not use SiteTrack. SiteTrack is for business use only and is not offered to consumers.
Engineering drawings take precedence over any decision made, or work done, on site based on what SiteTrack shows. SiteTrack is a work-tracking aid only. The plan, schedule, cable lengths, symbols, checks, reports and QA sheets it shows are produced automatically from a copy of the drawing you uploaded and your own entries, and they can be wrong, incomplete or out of date. The issued, current, approved drawings, the Ergon Energy / Energy Queensland standards, construction manuals and conditions, the relevant legislation and standards, and the instructions of the responsible engineer and Ergon inspector always take precedence. You must build, inspect, test and certify from those documents and check anything you rely on in SiteTrack against them. A tick, a QA sheet or a reading recorded in SiteTrack is your own record. It is not an inspection, a hold-point release, a test certificate, a certificate of compliance, or an approval by Ergon or anyone else.
1. The service and what it is not
- SiteTrack lets a company upload underground electrical drawing sets (PDF), turns them into a site plan and a tick-off list, and lets people in the company record progress, issues, notes, earth readings and QA sheets. We may change, add, limit or remove features at any time.
- Reading drawings is automated and imperfect. Items may be missed, mis-read, mis-placed or mis-measured, and a drawing that looks right on screen may still be wrong. Features marked or described as new, beta or in development may change or fail.
- SiteTrack is not engineering, electrical, safety, legal or compliance advice, is not a safety system, and must never be used to decide whether it is safe to work on, energise, dig near or connect to any asset. You remain solely responsible for safe work methods, isolation and testing, licensing, and compliance with the Electrical Safety Act 2002 (Qld), the Wiring Rules, Ergon’s requirements and every other law and standard that applies to your work.
- Revisions are not tracked unless you upload the new revision. You are responsible for working to the latest issued revision.
2. Accounts, roles and your company
- You must be at least 18 and have authority to bind your company.
- Each person has one of three roles. A manager can upload and edit drawings, manage users, see who did what, complete QA, manage billing and settings. An installer can tick off work, report issues and enter readings. A viewer can only look at progress and cannot change anything. Managers decide who gets which role and are responsible for choosing it carefully and removing people who leave or no longer need access.
- Keep passwords secret. You are responsible for everything done through your company’s accounts, including by people you add or approve, and for any loss that results from sharing credentials. Tell us promptly if you suspect unauthorised access.
- Information you give us must be accurate and kept up to date.
3. Free week, plans and payment
- New companies get a free trial of 7 days. When it ends, the company’s data becomes read-only until a paid plan is chosen. Nothing is deleted by the trial ending.
- Paid plans are billed in advance by card through our payment provider, Stripe. Prices, upload limits and extras are shown in the app and are in Australian dollars unless it says otherwise, and are not refundable except as set out below. We do not see or store your card number.
- Plans renew until cancelled. You can cancel from Settings > Plan and billing; the plan runs to the end of the period you have paid for, then the company becomes read-only. Fees already paid are not refunded, except where required by law (including the Australian Consumer Law).
- If a payment fails, we may give a short grace period before the company becomes read-only. If a payment is disputed or reversed we may restrict the account while it is resolved, and you must pay our reasonable costs of a dispute you lose.
- We may change prices or plan limits on at least 30 days’ notice, effective from your next billing period. Prices exclude GST unless the app says otherwise.
4. Your drawings and data
- You own your data. Drawings, progress, issues, readings, logos and notes you put into SiteTrack remain yours (or your client’s). You give us a worldwide, non-exclusive licence to host, copy, process, transmit and display them, and to send them to the service providers described in our Privacy Policy, only so that we can provide, secure, back up and support SiteTrack for you.
- You are responsible for your content. You promise that you have the right to upload every drawing, logo and piece of content (for example under your contract with the developer, Ergon or the drawing’s author) and that doing so does not breach confidentiality, copyright or another person’s rights. Drawings may belong to other parties; we hold them for you as your service provider.
- Each company’s drawings and progress are kept separate from every other company’s. We do not open your drawings, jobs or progress, except where you ask us to for support, or where we must to keep the service secure, fix a fault, or comply with the law.
- How we handle personal information is set out in our Privacy Policy. You must have the right to give us the personal information of your staff and must tell them how it is used.
- Keep your own copies. You are responsible for keeping your own copies of the issued drawings, QA sheets, test results and any record you need for contract, regulatory or legal purposes. We keep backups for our own disaster recovery only. We do not promise that any data will be preserved, recoverable or free of corruption, and we are not an archive or a records-management service.
- You can export or delete your jobs in the app. We may delete data of a closed or non-paying account after giving reasonable notice (which may be by email to the registered address) once it has been read-only for 90 days.
5. Acceptable use
Do not: break the law; upload malware or material you have no right to use; try to access another company’s data or our systems or to test their security; overload, copy, resell, reverse engineer or scrape the service; use it to give false assurance of inspection, testing or compliance, or to record readings or inspections that were not carried out; or let people outside your company use your accounts. We may remove content or suspend access that we reasonably believe breaks these terms.
6. Availability, support and third parties
SiteTrack is provided on an “as available” basis. We do not promise it will be uninterrupted, secure from every attack, error-free, accurate, or usable on site where there is no phone coverage. It depends on third parties (such as hosting, payment and the automated drawing-reading service) that we do not control, and we are not responsible for their failures, changes or decisions. Plan for outages and keep the issued drawings and your own records available independently. We may change, suspend or discontinue SiteTrack, or any part of it, at any time, and will give notice where reasonably practicable.
7. Disclaimers, limits on liability and indemnity
This section applies to the maximum extent the law allows.
- Consumer law. Nothing in these terms excludes, restricts or modifies a right or remedy, or a guarantee, you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where a consumer guarantee applies to the service and the law lets us limit our liability for failing to comply with it, we limit it, at our option, to resupplying the service or paying the cost of having it resupplied.
- No warranty. Apart from those guarantees, SiteTrack, its outputs and any information in it are provided “as is” and “as available”. We give no warranty, express or implied, about accuracy, completeness, fitness for a particular purpose, suitability for site works, compliance, or that drawings will be read correctly.
- You rely at your own risk. You are solely responsible for how you use SiteTrack and for every decision, instruction, inspection, test, certification and piece of work you or your people make or carry out, whether or not SiteTrack was used in making it. We are not responsible for any defect in works, rework, re-inspection, delay, standing time, penalty, liquidated damages, failure to meet a contract or Ergon requirement, or damage to property, services or people, that arises from or relates to use of, or reliance on, SiteTrack, including any mistake in what it shows.
- Excluded loss. We are not liable for any indirect or consequential loss, or for loss of profit, revenue, contract, opportunity, goodwill, data or use, however caused.
- Cap. Our total liability to you and everyone claiming through you for everything arising out of or in connection with the service or these terms, in contract, tort (including negligence), statute or otherwise, is limited to the fees you actually paid us for the service in the 3 months before the event that gave rise to the claim.
- Indemnity. You indemnify us, and our officers, employees and contractors, against all losses, liabilities, costs (including legal costs on a full indemnity basis) and claims by any third party (including your clients, Ergon, developers, other contractors, your staff and regulators) arising from: your content or your breach of section 4 or 5; the works you carry out or certify; your reliance on SiteTrack instead of the issued drawings and Ergon’s requirements; or the acts or omissions of the people you add. This does not apply to the extent a loss is caused by our own deliberate wrongdoing.
- Time limit. To the extent the law allows, any claim against us must be started within 12 months after the event it relates to.
- Fair and reasonable. You acknowledge that these limits are fair given the price of the service and that you are able to get your own insurance, and should hold appropriate insurance (including professional indemnity and public liability) for your work.
8. Suspension and ending the agreement
You may stop using SiteTrack at any time. We may suspend or end your access at any time if you breach these terms, if your account is unpaid, if we reasonably suspect misuse or a security risk, or if we stop providing the service. Where we end the service without breach by you, we will refund any fees you paid for the period after it ends. On ending, anything that by its nature should continue (including sections 4, 7, 9 and 11) continues, and you remain responsible for fees owing.
9. Intellectual property and permitted use
SiteTrack, including its software, source code, design, layouts, drawing-reading methods, text, logos and names, is owned by O’Donnell Systems and its licensors and is protected by copyright and other laws. Nothing in these terms transfers ownership of any of it to you.
While these terms apply and your fees are paid, you get a limited, non-exclusive, non-transferable, revocable right for your company’s own staff to use SiteTrack for your company’s own internal work. Every right not expressly given to you is reserved.
You must not, and must not let anyone else:
- Copy SiteTrack or any part of it, including its screens, layouts, workflows, reports, QA sheets or text, other than printing or saving your own reports and data for your own use;
- Reverse engineer, decompile, disassemble or otherwise try to discover the source code, data models, prompts or methods behind SiteTrack, or bypass any security, usage limit or access control, except to the extent the law expressly allows despite this restriction;
- Resell, sublicense, rent, lease, white-label, time-share or otherwise make SiteTrack or its output available to anyone outside your company as a product or service, or share logins with people outside your company;
- build, or help someone else build, a product or service that copies or competes with SiteTrack using SiteTrack, its output or anything learned from accessing it;
- scrape SiteTrack or extract data from it by automated means, other than the downloads and exports it provides; or
- remove or change any copyright, trade mark or other notice in SiteTrack or its output.
Breaching this section is a serious breach of these terms. We may suspend or end your access straight away under section 8, and we may seek any other remedy available to us, including an injunction. Your own data stays yours as set out in section 4.
If you tell us ideas or feedback, we may use them without payment or credit. The QA sheet layout is provided as a convenience; it is not an Ergon or SPA document and does not imply their approval.
10. Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of the internet, power, hosting, payment or other third-party services, cyber-attack, natural disaster, industrial action, pandemic, or changes in law.
11. General
- Changes. We may update these terms. For a material change we will give notice in the app or by email at least 14 days before it takes effect. Continuing to use SiteTrack after that means you accept the change. If you do not accept it, stop using SiteTrack before it takes effect.
- Law and courts. These terms are governed by the laws of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Queensland.
- Whole agreement. These terms and the Privacy Policy are the whole agreement about SiteTrack and replace anything said or written earlier. You have not relied on any statement not set out in them.
- If part is unenforceable, it is read down or removed and the rest continues. Not enforcing a right is not giving it up.
- Assignment. We may transfer our rights and obligations to a successor to the business on notice to you. You may not transfer yours without our written consent.
- Notices. We may give notices by email to your registered address or in the app. Notices to us go to sam.odonnell.au@gmail.com.
- Electronic acceptance. You agree that ticking the box when registering, and using SiteTrack, is a binding signature of these terms.
